Health permit: county health department
The Alabama Department of Public Health (ADPH) permits mobile food units through county health departments. A mobile unit is self-contained, with its own drinking water and waste water tanks, and returns to its commissary daily. ADPH's plan review checklist (July 2026) asks for:
- A permitted commissary the unit returns to daily
- A waste tank at least 15% larger than the drinking water tank (ours are 40 gal fresh and 53 gal waste)
- The commissary's name, address and phone on two sides of the unit, with the name at least 3 inches high
- An authorization letter to operate in each county
New law: statewide certificates from 2027
Alabama SB197 (2026) took effect July 1, 2026. From January 1, 2027, a mobile food unit with a valid health certificate, from the county health department where its commissary is located, and a valid fire certificate is exempt from further local health and fire inspections. Local governments can still inspect at any time and require business licenses. Operating without both certificates is a Class C misdemeanor.
The State Fire Marshal sets one statewide fire inspection: NFPA 96 hoods and suppression, with servicing and hood cleaning every six months; LP-gas systems to NFPA 58, with a yearly pressure test by a fitter certified by the Alabama LP-Gas Board; and NFPA 70 electrical. The fire certificate is valid for six months.
Title and registration
The Alabama Department of Revenue issues titles and county licensing officials issue tags. The Department lists utility trailers, boat trailers and bumper-pull trailers as not requiring a title; ask your county licensing official how your food trailer is classed. Either way it is registered, and Limestone County lists the Manufacturer's Statement of Origin and a bill of sale with the make, model year and VIN, with no visual inspection.
Sales and use tax
Alabama charges a 2% state automotive rate plus local rates. For a trailer bought out of state, the use tax is paid to the county licensing official before registration. When we ship the trailer to you by carrier, no Texas sales tax is charged; see nationwide delivery.
Rules and fees change and some cities and counties add their own. Confirm current requirements with the agency before you buy or apply.
